Only products in stock will be accepted for exchange within 30 days. To do so, the Customer must obtain written authorization from COMERCIAL L & M LLC. The equipment must be shipped to our address, and freight must be paid. Warehouse classification is subject to change without notice, and the classification that the product had when the order was placed will be valid. These circumstances do not exempt the Customer from paying for the equipment subject to return.

When the return is due to reasons attributable to COMERCIAL L & M LLC, the corresponding credit will be granted, including all transportation costs. COMERCIAL L & M LLC reserves the right to accept product returns under the condition that the equipment and packaging are in perfect and absolutely unused condition. Returns accepted through the Commercial Agreement will be governed by the criteria and timelines established therein.

FORCE MAJEURE

COMERCIAL L & M LLC is not responsible for non-compliance or delays in compliance due to adherence to any regulation, order, act, instruction, or priority request issued by any federal, state, or municipal government or by any department or agency thereof, civil or military authority, acts of God, fires, floods, strikes, or other labor difficulties, acts or omissions by the Buyer, embargoes, war, hostilities, riots, shipwrecks, transportation delays, or due to any other cause beyond the Seller’s control.

In the event of a delay in compliance due to any of the above causes, the delivery date or execution time will be extended for a period reasonably necessary to overcome the effect of the delay, without any penalty. Any contractual clause related to penalties for late deliveries will be void if any of the aforementioned conditions occur during the manufacturing and transportation period of the products.

WARRANTY

COMERCIAL L & M LLC guarantees all products in all their parts and workmanship, as well as any manufacturing defects, from the delivery date under the following conditions:

For this warranty to be effective, no higher requirements can be demanded than the presentation of the purchase invoice and the product directly at the factory or with the Distributor where it was purchased. COMERCIAL L & M LLC commits to repairing or replacing the defective product at no charge to the customer, or issuing a credit note covering the cost of the product.

A warranty claim on our products does not exempt the customer from paying the invoice or any payment obligation with COMERCIAL L & M LLC, such as advances, negotiated progress payments, invoices, or others.

This warranty is not valid in the following cases:

If repairs or modifications to the products are carried out by persons not authorized by the company and without the approval of the warranty department of COMERCIAL L & M LLC.

If the product has suffered essential, irreparable deterioration or serious damage due to improper application or use attributable to the user (wear, rust, cracks, impacts, violated seals, missing labels, missing parts, etc.).

If the warnings indicated in the product manuals, catalogs, and labels have not been observed.

If the warranty is untimely.

The liability of COMERCIAL L & M LLC arising from product malfunction is limited to covering the product warranty and does not assume any additional costs arising from the loss of profits, third-party damages, or consequences.

All expenses generated by the works carried out by COMERCIAL L & M LLC as a result of a warranty claim for a product that is not valid will be charged to the customer.
